Wetzel County man convicted for unlawful possession of firearms

A Proctor, West Virginia resident was convicted on two firearms charges after authorities found 15 guns and over 3,500 rounds of ammunition in his possession. The announcement was made by U.S. Attorney Matthew L. Harvey.

Gary Dean Siburt, age 62, was found guilty of unlawfully possessing a firearm and ammunition due to previous felony and domestic violence convictions. Evidence presented during the trial included Siburt’s prior convictions, which legally barred him from owning firearms. Law enforcement officials seized the weapons and ammunition from his home during their investigation.

Siburt could face up to 15 years in prison for each count. Sentencing will be determined by a federal district court judge who will consider the U.S. Sentencing Guidelines along with other statutory factors.

The prosecution was led by Assistant U.S. Attorneys David Perri and Clayton Reid. The Bureau of Alcohol, Tobacco, Firearms and Explosives and the Marshall County Sheriff’s Office conducted the investigation.

U.S. District Judge John Preston Bailey presided over the case.

This prosecution is part of Operation Take Back America, an initiative that uses Department of Justice resources to address illegal immigration, eliminate cartels and transnational criminal organizations, and protect communities from violent crime perpetrators.
